California ABC License LimitationsOne of the most misunderstood aspects of California liquor licensing is why some licenses can be purchased directly from the ABC immediately, while others command up to six-figure prices on the open market. The answer lies in California’s population-based license allocation system.

California limits the number of new “general” liquor licenses that may be issued in each county. For on-sale general licenses for bars and restaurants (Types 47, 48, and similar), the state generally allows one license for every 2,000 county residents. For off-sale general licenses for retail stores(Type 21), the ratio is one license for every 2,500 county residents.

Each year, the California Department of Alcoholic Beverage Control (ABC) reviews county population growth and determines whether additional licenses may be issued. When new licenses become available, ABC conducts a priority drawing (lottery) for qualified applicants.

Why This Matters for Your Business

If a county’s population has grown faster than the number of licenses, the ABC may release a few new “original” licenses through an annual Priority Drawing (lottery) held every fall.

However, if your county is already “at capacity” according to these ratios, your only option is to purchase an existing license from another business on the secondary market, often at a significant premium.

In many counties, demand far exceeds the number of licenses available. This limited supply is one of the primary reasons why liquor license values can vary dramatically across California.

Additionally, applicants should be aware of “overconcentration” rules. Even when a license is available, a location with a high concentration of existing alcohol licenses may require a finding of Public Convenience or Necessity (PCN) from the local governing body before ABC will approve the application.

Whether you’re opening a restaurant, bar, convenience store, grocery store, or entertainment venue, understanding license allocation ratios and county availability is critical before signing a lease or purchasing a business.
